Extra Large Clothing Terms and Conditions of Sale

 

The following terms and conditions apply to all sales transactions made with Extra Large Clothing. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully.
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
We have the right to refuse at our discretion to supply any goods ordered by you.

Description of Goods/Warranty and Liability
We warrant that the goods will, at the time of delivery, correspond to the description given by us. Except where the Customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the Customer warrants that the Customer is satisfied as to the Suitability of the Goods for the Customer's purpose. Goods are not sold on a trial basis.

Typographical Errors
In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.

Product Images / Specifications
Whilst we endeavour to ensure all images and specifications are correct at the time of publication, they do vary. As such we can accept no responsibility for incorrect images/information. If however you spot a mistake with an image or with a product’s specification please let us know.

Availability of Goods
All products are subject to availability and may be withdrawn at any time. However it is our policy to contact you if a product is out of stock and if you do not wish to proceed with the order or for any reason we cannot supply the product we will arrange for the order to be cancelled.

Liability
Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure
We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.

No Waiver
Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.

Severability
In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

These Terms and Condition shall be construed in accordance with English Law.


Extra Large Clothing Shipping Terms

 

UK mainland orders may use the option of next working day delivery. This applies only to orders received before 3pm, after this time we cannot make any guarantees for next day delivery, and your order may be delayed by one day. This option excludes custom products, which are made to order and can take up to 3 weeks to deliver.

Important Note: The customer is responsible for completing full order details; Name, Billing Address - as it appears on the card statement address, Delivery Address, email contact and associated telephone numbers to the fullest. This will ensure that all orders are processed in a timely manner. The details Extra Large Clothing request are processed through a verification service and failure to provide complete and accurate details may cause a delay in processing and dispatching any order.

Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

Failure by the Customer to pay for any instalment or delivery when due shall entitle us to withhold further deliveries and the Customer shall be liable for any costs incurred by the Supplier relating to such Goods which the Supplier is then entitled to withhold.

Delivery of the Goods shall be made to the Customer's address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Goods left on request by means of Special Delivery Instructions are the responsibility of the customer and we will not be held liable for missing or stolen items.

Customs
If you are requesting delivery to a country outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Additionally, when ordering from Extra Large Clothing, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Shortages, Damage or Incorrect Goods
It is the Customers responsibility to notify us of any shortages, damage or incorrect goods supplied within 48 hours of delivery.

Non-Deliveries
We will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date.

 

Extra Large Clothing Returns and Refunds Policy

 

We want you to be pleased with your purchase. However should you wish to return an item purchased from us, we will be happy to refund or exchange a product as outlined below.

You have the right to cancel your order within 14 working days from delivery.* You must notify us by phone or e-mail of your intention to cancel within 14 working days from the delivery date.

*Excludes Made-to-Order and Special Order products, please see below:

Cancellation of made-to-order products

Should you wish to cancel your made-to-order or special order product for any reason, it is unlikely that we could sell it to another customer at full selling price. We will therefore charge a cancellation fee of 25% of the full selling price.

In respect of made-to-order products our usual refund policy does not apply and products cannot be returned or exchanged unless faulty.**

**None of the above conditions affect your statutory rights when goods are faulty, or not as described.

Important Note: You must organise the return of the unwanted items at your expense and risk. Where possible please use a recorded delivery service where a signature must be obtained to avoid delay and loss of your parcel. Returns cannot be accepted without prior authorisation. The returns authorisation is valid for up to 14 days only. Goods sent back without prior returns authorisation may be returned back to you and the cost of delivery charged to your account.

Full refund of the cost of the goods is wholly conditional upon the conditions being met below and the refund authorised only after a full inspection of the goods by our Returns department to check for completeness and correct product return.

Once completion of a return has occurred, any monies due to the customer will be administered in a timely manner. However please be aware that this can be up to 14 days.

Conditions on Returning

  • Goods must be complete, unworn, and in 'AS NEW' condition and must be re-packaged as received.
  • Goods must be returned to our Returns Department within 14 days from authorisation. We are unable to accept returns of un-wanted and non-faulty items after 14 days.
  • Any 'FREE GIFTS' with the products must also be returned.

Delivery Charges

We will refund your original delivery charge when a product is faulty or damaged, but not when a product is simply unwanted.

While maintaining our commitment to your privacy, we do collect personally and non-personally identifiable information about you. We use this information to optimise the shopping experience and contact you about the services on our site in which you have expressed interest.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a court order, or legal process served on our Web site.

Agents: We may use an outside shipping company to fulfil orders, and a credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purposes.

Personal Information and Payment Security: We maintain administrative, technical and physical safeguards to protect against unauthorised access, use, modification and disclosure of Personal and Payment Information in our control. We also are committed to employing industry standard technology in order to protect the security of our web site. However, even with the best technology, no web site is 100% secure. Extra Large Clothing takes reasonable measures which we believe are appropriate to protect your Personal Information from loss, misuse, alteration or destruction.
